Getting Your Affairs in Order: A Guide to Living Wills

Living wills--sometimes referred to as "health care directives"--are for adults of all ages, not just the elderly. Some of the most recognized court cases concerning the "right to die" issue have involved people in their 20s and 30s--people like Karen Quinlan and Terri Schiavo. Living wills are essential documents for conscientious parents and spouses. Why leave your family in a constant state of worry and confusion when a legal document can specify your personal desires pertaining to the end of your life.

Items such as: sources of income, Social Security and Medicare information, life insurance information, location of deeds and important legal papers (birth certificates, etc.), location of personal items such as jewelry and family treasures, name and number of your checking and savings accounts should all be included in a list of "important papers." As of 2004, about 25 percent of all American adults have a living will which specifies the medical treatment people do or do not wish if they become terminally ill or incapacitated.

Although different states have different rules for what living rules should cover, all states allow you to decline aggressive life support if you're close to death, without affecting your right to get pain relief medications or other "comfort care." Refusing medical treatment is not considered suicide, since it is not illegal or immoral to let nature run its course. The best way to express your views and desires on "end-of-life" issues is to write them down. There are many different types of legal documents that can help you plan how your affairs will be handled in the future.

Advance directives describe your health care wishes in case you can not speak for yourself.A power of attorney lets you give someone the authority to act on your behalf. The three basic types are: a standard power of attorney; a durable power of attorney; a durable power of attorney for health care which allows you to name another person to medical decisions for you if you are unable to make them yourself. Finally, a living will explains how you want your health care handled if you are in a life-threatening situation and can not make medical decisions yourself.

No one ever plans to be sick or disabled. However, it is just this kind of advanced planning that can be of major assistance in times of emergency. No amount of planning can cover all the problems that can arise when we get old or sick.

How To Make $100,000 An Hour

It may seem unbelievable but it's possible to make hundreds of thousands of dollars in a matter of hourslegally and tax-free. To see if you qualify, read on.I recently met with a successful dentist and his wife. They were in their mid 60's and had worked for years to achieve a level of wealth that would allow them a comfortable lifestyle. Including real estate, investments, retirement accounts and life insurance, their net worth was approximately 3 million dollars. The dentist made approximately $200,000 per year from his dental practice.

I was able to show them how he could make 4 years worth of income in only about 8 hours. If you've been successful and have achieved this level of wealth, this opportunity may apply to you as well. They have successfully run a dental practice for almost 30 years and have put money away each year into a retirement account to provide for their future. They purchased a home and an office building and sacrificed for years to pay off the mortgages to own them free and clear. They followed the right steps and accumulated wealth.

Believe it or not, this dentist and his wife who were worth over 3 million dollars don't even have a Last Will and Testament. That oversight could cost them $800,000 and means that their estate will be tied up in Probate when they die. The courts and attorneys will be involved in the process. It could take a year or longer before their assets passed to their children. Probate alone could cost tens of thousands of dollars in legal fees.Since they don't have a Last Will and Testament, it will be up to the State to decide who will receive their assets at their death.

And there's nothing the surviving family members can do about it.That's not the worst part of it. Their lack of planning could result in almost $800,000 of the estate being lost to Federal Estate Taxes and State Inheritance Taxes. Think how long they worked and sacrificed and saved to accumulate $800,000. Yet it could be lost--going to the Federal and State governments instead of to their heirs.Fortunately, it's not too late for this couple.

Last Will and Testament drafted, signed and witnessed. That's it. It's that easy. Legal, tax-free money that otherwise will be lost. A Last Will and Testament only costs $500-$1,000 and can include the language necessary to save almost $800,000 in estate taxes. A Last Will and Testament will still require their estate to go through probate though. With a little additional work and an additional $500-$1,000, a Living Trust can be drafted in addition to their Last Will and Testament.

Living Trust would avoid Probate, be easily managed should they become incapacitated and settled at their death without involving attorneys or the courts. Many people find it easy to procrastinate when it comes to having a Last Will and Testament or a Living Trust drafted. They recognize the need, but the day-to-day pressures of life force it to the back burner. If you had the ability to make several hundred thousand dollars in just a few hours, wouldn't you make time to do it?

So don't delay. Take action today to get a Last Will and Testament and a Living Trust. You and your heirs will be glad you did.If you have questions about how to plan your estate and would like free, unbiased advice, send your questions to e-mail protected from spam bots. Insider Sports Betting System Revealed

In the world of gambling one of the earliest documented gambling professionals is probably Charles de'ville, who in the early 1890's successfully used a gambling strategy called "The Martingale".In theory, this gambling system can't fail to make a profit and involves gambling on the "even money" chances at casino games such as roulette and blackjack...With this gambling system, each time you place a bet on an even-money chance. If you win, you double your money. If you lose, you simply double your stake next time and so on until you gain a win.

Casino Roulette table to fall on say "Red" all night. The down side to this gambling strategy is that your stakes accumulate quickly when a losing run develops. As you can work out, a losing run of six will cost 63 units in the pursuit of a one-unit gain. However, the probability of this happening is 64 to one. If your lucks in, and over short periods of gambling, you can certainly win with this old gambling strategy (or a big loss!)The James Green Story:5 years ago bookie assistant James Green stumbled across a math-formula that changed his life instantly.

James decided to become a professional gambler, even thou he always preached "the player never wins in the end"!What did the math-formula show James? The original formula which he found proved to James that it indeed was possible to "rob" the bookies and sports books legally and beat them at their own games making guaranteed profits betting on sports such as football and basketball!

Would his so-called guaranteed winning sports betting system make him go bust or actually workLike most Hollywood movies I can tell you this man's journey to become a professional gambler and legend comes with a guaranteed happy ending!James Green made millions in guaranteed profits betting on sports offline. Because as he states; "When I left my job all I knew about was how real bookies and their "shop" worked. Now with the information-highway anyone can do what I did just in half the time and make a living betting on sports - They can even sit from home and use the computer to do it.

December 12th 2004 James Green officially launched the website www.robthesportsbooks.com where he teaches people interested in his findings 5 years ago and how normal people like himself can make guaranteed profits betting on sports online and offline. His answer to why share the secret he replies; "Down through the ages, people have believed in luck when it comes to gambling.

CoVirt / CANNEX Agreement for Annuity Surveys

Toronto (ContentDesk) March 22, 2006 -- CoVirt Inc. (Canada) announced today a fee agreement and increased integration with CANNEX Financial Exchanges Limited for payout annuity surveys. Payout annuity surveys are normally available directly from CANNEX at a cost of $5 per survey. Under the terms of this agreement VirtGate users will have their monthly CANNEX survey charges capped at 15% of their monthly CoVirt fees.Access to CANNEX annuity surveys is completely seamless and transparent to a user logged in to the VirtGate site of a participating MGA or National Account brokerage.

Fitzpatrick, President of CoVirt said I suspect it will be all or nothing and so the effective result will be unlimited access and unlimited surveys by all advisors and staff. There are four aspects to the business case for the VirtGate brokerage. First, there is the internal staff savings resulting from providing 24/7 access to advisors. If the advisor can self-serve, the staff does not have to run the quotes. Secondly, there is a tremendous value added, resulting in greater attraction and retention of advisors to both the brokerage and the web site.

Finally, this increased awareness of annuities by advisors results in more sales and commissions for the brokerage which will more than offset the cost. The key to the accuracy and timeliness of the annuity surveys provided by CANNEX is that CANNEX crunches the participating companies actual calculation algorithms simultaneously to generate marketplace surveys. Most companies fully guarantee the accuracy of annuity quotes provided by CANNEX on their behalf.

CANNEX then calculates an apples-to-apples comparative surveyinstantly. Quotes are available in both English and French.Annuities are unique products sold by life insurance companies where, in exchange for a single payment, the company provides the annuitant(s) with regular income payments - generally for the rest of the annuitants life. Tim Fitzpatrick said I recently advised my own mother to use a life annuity instead of a RRIF. The annuity paid more income for most years and was guaranteed for life, whereas all projections for RRIFs had the funds drying when she turned 90.

To ensure that she was getting the best deal, my mothers advisor had provided her with CANNEX surveys.About CANNEX:Since 1984 CANNEX has been providing agents and brokers with comparative surveys of the Canadian payout annuity marketplace. In addition, CANNEX gathers, compiles and distributes comparative information about a variety of financial products and services (GICs, RRIFs, Mortgages, Mutual Funds, Stocks) available in Canada, the United States, Australia and New Zealand.

Living the Year of the Eucharist

Living the Year of the EucharistAn Author Interview with Michael Dubruiel, How to Get the Most Out of the Eucharistby I believe that our Holy Father, Pope John Paul II left us a precious gift prior to his death when he declared this to be the "Year of the Eucharist". In the weeks since his passing, I have felt myself drawn compellingly to the Eucharist and to quiet time spent in Eucharistic adoration.

Thanksgiving at the election of our new Pope Benedict XVI, I have seen the beauty of the "Body of Christ" in the faces of my fellow parishioners and those around the world witnessing the unfolding of these historic events. I am trying, in my own very little way, to live out and to fully embrace the Year of the Eucharist.A guide and enlightenment to me in the past few weeks has been a new book written by noted author Michael Dubruiel.

Get the Most Out of the Eucharist (Our Sunday Visitor, March 2005, paperback, 144 pages) offers Dubruiel's "SACRIFICE" model, nine concrete steps to take to maximize one's experience of the Eucharist. In practical yet inspiring terms, Dubruiel writes for people like me who are striving in their own simple ways to embrace true communion with Jesus Christ. One of the many highlights of the book is the recurring segment "Lessons Learned from a Three Year Old", inspired by the wise-beyond-his-years philosophy of Joseph, the son of Dubruiel and his wife and fellow author Amy Welborn.

Dubruiel about his new book and this Year of the Eucharist.Q: With the passing of our Holy Father, Pope John Paul II, please say a few words about our former Pope and his impact upon the Eucharist in today's Church.A: St. John Bosco once had a vision where he saw a boat, symbolic of the church being tossed about in rough seas He then saw a pope take the helm of the ship and navigate between two pillars, one on which was the Blessed Virgin Mary the other a monstrance containing the Blessed Sacramentthat was in 1862.

Pope John Paul II was that pope and what we have witnessed during the last twenty-six years of his papacy is a righting of the ship that is they church by restoring devotion to the Blessed Mother who helps us to focus on Jesus and by recalling both the adoration due to the Eucharistic Lord but also the sacrifice required of each of us who participate in the Eucharistic banquet that the Lord has prepared for us by His Sacrifice.

Year of the Rosary and the current Year of the Eucharist, Pope John Paul II has set the course for a new evangelization that God willing we will all witness in the coming years.Q: Given this "Year of the Eucharist", your book is very timely. What prompted you to take on this topic? What is your goal for the book?A: I had been giving a talk to various groups around the country with the title "Setting Your Heart on Fire at Every Eucharist" after The How-To Book of the Mass was published by Our Sunday Visitor in 2002.

Eucharist was being celebrated in their parishes. Now this "dissatisfaction" was all over the place and usually reflected the ideology of the group that I was speaking tomy original intention when I began the book was to address this "dissatisfaction" that I encountered but in the meantime Pope John Paul II released an Encyclical on the Eucharist and a year later an Apostolic Letter. After much reflection on both, what I ended up doing does address the dissatisfaction--but in a way that even people who aren't dissatisfied will find a way of being at Mass that will benefit them even more.

Eucharist: to both encounter Jesus there but also be united with Jesus there by giving ourselves fully to Him. Many of the reasons the Holy Father had given for declaring this the Year of the Eucharist are the very fabric of what I deal with in the book.Q: I was moved by your comments emphasizing the importance that we approach the Eucharist from a sacrificial perspective. Why is this so important, and yet so difficult?

In preparation for writing How to Get the Most Out of the Eucharist I asked for feedback on the internet at my Annunciations blog, http://michaeldubruiel.blogspot.com), from other Catholics on what were the principle obstacles that kept them from getting the most out of the Eucharist. Their responses came in quickly and in large numbers and they were passionate. They varied from dissatisfaction with the music used in their parish to the poor quality of the homilies preached, interestingly no one commented that they themselves might be the biggest obstacle to what they were experiencing.

Amy and she thought about it for a second and said "they are frustrated because they have no control." I knew from conversations I had with priests and liturgists that this was exactly what they felt too!Pope John Paul's Encyclical on the Eucharist came to my mind when I was trying to respond to this very real angst. I thought about what the Holy Father had said about the "sacrificial" aspects of the Eucharist not being stressed or understood by many modern Catholics.

I knew had a different attitude that they brought with them to Massan attitude that is reflected in the old adage to "offer it up"that those things that trouble us can be beneficial not only to us but to others if we see them as our sacrifice to offer. Now, I think sacrifice is always difficult if we forget the reason for doing itand that reason is usually related to love. When we love, sacrifice makes sense but when we no longer love, sacrifice can become almost unbearable.

How to Get the Most Out of the Eucharist when I talk about the need to "adore" Christto rekindle devotion to Him, to be reminded that He is the reason that we come to Mass, that He has first loved us and is worthy of all our love and sacrifice. This is a topic that I'd like to deal with further in two future books written along the same lines as this one. I envision a "How to Get the Most Out of the Rosary"by contemplating on the face of Christ with Mary (again inspired by the Holy Father) and "How to Get the Most Out of the Bible"by reading it to fall in love with Jesus all over again.

Your concrete "SACRIFICE" model offers readers nine concrete steps to take to maximize their experience of the Eucharist. Could you please say a few words about these steps and how you developed this model?A: I've mentioned above how the idea of using "sacrifice" as the guiding attitude necessary for getting more out of the Eucharist, as it is also for living the Christian life. The idea of building the book on the word came to me when I was running one day and it seemed to fit perfectly with what I wanted to cover in the book.

Catholic understanding of the purpose of life to know, love and serve God.S stands for Serve. Every Holy Thursday the Church presents us with the Gospel of Jesus washing the feet of his disciples at the first Eucharist and telling them that He was giving them an "example", a model to follow. It is easy to forget how important service is to following Christ until the Church reminds us.A stands for Adore, if we forget about who Jesus is, God and all that we owe God we are apt to approach Him in a way that doesn't fully acknowledge the all important acts we are partaking.

Confess, and I use it in both of its meanings to confess our belief in God and to confess our sins. They both our related and when we really know who God is then we come to know who we are and how we fall short of living and trusting in His love for us.R stands for Respond and it seems to go without saying that if we want to get the most out of the Mass we need to respondyet it is amazing how difficult this can be for all of us at times because we often have to sing songs we don't particularly care for or stand or kneel longer than we feel like.

Jesus with a list of excuses rather than a "leaving everything to follow Him" response.I stands for Incline your ear, to make a strong effort to listen to what God might be saying to you at Mass.F stands for Fast, making sure that we come to the Eucharist with a hunger to truly enjoy what the Lord is giving us.I stands for Invite; to consciously as the Lord to "stay with us", to invoke the prayer of the early Church at the Eucharist Maranatha meaning "Come Lord."C stands for Commune; to truly give ourselves to Christ and to accept new life in Him when we receive His Body and Blood.

Evangelize; to share what we have been given realizing that the very life of our family, friends and those God places in our path depend on hearing about Him.Q: As always with your writing Michael, I found this book to be a wonderful combination of insightful philosophy and readable, workable advice. A particular favorite of mine in this book are your "Lessons Learned from a Three Year Old" comments in each chapter, which provide simple, real life instruction. How did your relationship with your son Joseph impact on the writing of this book and your experience of the Eucharist?

Joseph was two when I was preparing a lengthy talk on the Eucharist for an event in St. Louis a few years ago. He kept coming to see what I was doing and at the time I was having difficulty coming up with a way to illustrate the idea of "giving thanks always"something that appears in the "Adore" chapter of How to Get the Most Out of the Eucharist. I was sending him away with a gentle reprimand and in response he said, "Thank you" something he did at that age (I think he though it meant "okay"). I realized that God had just sent me my illustration.

Joseph is about to turn four in April) Joseph continued to put what I propose in the book to its toughest test and yet confirmed that what I was putting forth was indeed practical. I am reminded of one time when Joseph was clamoring for attention to have help with his runny nose and as I fished out a handkerchief and bent down to wipe his nose I heard the priest proclaim from the Gospel "whatever you did for the least of my brethren you did for me." I realized that Joseph and all of his young peers out there have a lot to teach us about keeping Christ in the Eucharist!

Joseph parts first, secondly while I was answering this question Joseph made an appearance to tell me that I really should pick up my books which are all over the floor near my desk.Q: For those of us looking to truly embrace this "Year of the Eucharist" what are some of the most important steps we can take during the remainder of the year?A: The most important element is to understand it all in terms of Jesus. Adore Jesus in the Blessed Sacrament, take the Gospels with you to learn again who He is and that He founded a Church with Peter as its head and that he left us the Eucharist as a gift.

Holy Father's beautiful writing on the Eucharist, rediscover the "awe" we should have or as my friend Father Stan Fortuna likes to paraphrase the Holy Father "be amazed" at both the mystery of the Eucharist and its power to transform us more perfectly into communion with Jesus. Q: Your book includes a helpful appendix for those attending Mass but unable to receive Holy Communion. Can they, too, get more out of the Eucharist? How should Catholics with family or friends in this situation minister to their loved ones?

I believe that the Eucharist is Jesus and that when we are at Mass we encounter Jesus, so even those who cannot receive Him in Holy Communion can still encounter him if they open themselves up to His grace. Helping our family or friends in those situations to see this (and of course our young children who can't receive yet) opens the door to them getting more out of the Eucharist.

I was writing the book that called my attention to the fact that there are those who attend Mass frequently but can't receive or think they can't (and I address this latter group by telling them to seek out a priest and make sure that it is the case rather than relying on the advice of some well meaning Catholic relative who might not know but might think that they do).

Mass with a Catholic spouse for their entire lives and have found ways to participate with our receiving communionone such person recently commented to me that she had read the book and really like it, she didn't say but I'm guessing she liked that I had addressed her situation in the book. Q: Michael Dubruiel, thank you for another wonderful resource in How to Get the Most Out of the Eucharist. Are there any closing thoughts you would like to share?

Thank you for taking an interest in this book, I hope this book will help all of those faithful Catholics and not so faithful ones to a renewed experience of Jesus Christ at every Mass. For more information on How to Get the Most Out of the Eucharist visit http://www.catholicmom.catholiccompany.com/product_detail.cfm?ID=6348 is a mother of two sons, webmaster of numerous web sites, including http://www.catholicmom.com and http://www.christiancoloring.com, and an avid reader of Catholic literature.

When Your Bills Are Piling Up Here Are 6 Different Ways to Consolidate

When it comes to debt consolidation some people dream of day when all their bills will disappear. Next to hitting the jackpot, a debt consolidation loan is some times the only way out for a debtor. No more playing "pick the bill out of the hat" to see who gets paid, all you have is one affordable check to write each month and pretty soon the balances quickly disappear. WAKE UP! Come back to reality, it isn't quite that easy, however if you do it right it works pretty well.

Ways to Consolidate People ask me "What's the best way to consolidate debt?" and of course "What's the catch?" Well, it just really depends on the situation. There are all sorts of ways to do it and some folks get really creative too. I'll tell you about some of the more popular ones and the pros and cons you get with them. Just remember because it looks good doesn't mean it is. The advertisers now a days are pretty good about disguising those higher interest loans with payments that go on forever because all you see is the lower payment.

First things first. Let do a little wake up call. If you are just barely trending water because you are in to much debt, just realize that not all these options will work for you. And some times, no of them will. If that's you, keep your head up high and don't drown. Many people can really cut their debt without ever consolidating. And don't forget, if you do decide to get a debt consolidation loan, don't think the fairy god mother is going to make thing all better. After all, once you do a debt consolidation you will still have to make a payment until that loan is paid off.

Equity Loans If you have been paying on your home for a couple of years, put a pretty big down payment when you got it and are lucky enough to be in one of those areas of the country where the home values shot through the roof, you may be sitting on little piece of freedom in the form of equity in your home. To get to this little nest egg you either have to sell your home or borrow money against it. And so enters the home equity loan. Another little thought...If you still owe a considerable amount on your home, IGNORE the ads for home equity loans for more than the value of your home.

And if you are still considering one of those loans Contact Me and I'll be more than happy to give you a hundred thousand reasons not to. If you want to be a stickler about it there are actually two different types of home equity loans. The first, which is my favorite, is the home equity line of credit (HELOC), it uses the equity in you home like a credit card. You can use a little as you want or up to your limit, and once you pay it down enough you can keep on doing it.

Hence, that's why it's my favorite. And the other type is a fixed amount, rate and term. Your payment stays the same all the time. Just to make this simple when I talk about a home equity loan it will refer to both of these types. Many people use home equity loans for debt consolidation. They will often get a pretty good interest rate, and since you can deduct interest payments on their taxes, making the "real" cost even lower. But, of course there is a down side, you must use your home as collateral. Which is just a fancy term to say if you miss your payment I can take your house.

There goes the roof over your head...Literally! Consider a Home Equity Loan for Debt Consolidation if: You won't be leveraging your home so much that you are borrowing pretty close to, or more than, the current market value of your home. You can pay it back in 5 years or less You are in debt because of unusual circumstances, like an unexpected accident or hospital bill, but for the most part you have excellent money management skills. DON'T use a home equity loan for debt consolidation if: You are going to have to borrow 100%-125% of your home's value.

Your marriage is on the rocks. Separation and divorce may not make it possible for you to remain living there. Especially if you have a court order to move. Not to mention you would loss a great deal of money if you had to short sell it (You would still have to pay off the mortgage before you can sell it) Now if you think that you are in debt because you just don't make enough money...well, I am surprised you made it this far. With that type of thinking as soon as you pay off your credit cards you will just find another excuse to charge them again, then your home will really be at risk.

Cards Consolidating your debt on a credit card comes off as a pretty bad idea; however it can actually be a great resource if done correctly. Credit cards sometimes offer some of the lowest interest rates around and they are easier to acquire than most debt consolidation loans, but the best part is that they don't require collateral like your home equity line does. That is an important thing if a bad situation pops up and catches you unprepared.

A big warning here...READ THE FINE PRINT! Make sure if you transfer the balance it will help you not hurt you. I give more tips on how to handle this in my FREE newsletter so make sure you sign up. Consider using a credit card for debt consolidation if: You can get a lower interest rate; make sure it is a fixed rate and not just a low intro rate, that's how they get you. Please Read The Fine Print. You never pay the minimum payment, and they tease you with a really low one, and you pay as much as your budget will allow each month to get rid of the debt quickly, after all that's what this is for.

A word of caution if you close too many account it will hurt your credit score. Don't use a Credit card for debt consolidation if: You can only get an interest rate that is higher than what you have because you have bad, dinged, or a bruised credit history. You are just so addicted to your credit card that you can't bear the thought of getting rid of one or more of them. You lack consistency in paying your bills on time. All those late fees start to add up pretty quick at $25-$30 a pop, and then you pay 18%-30% interest on the late fees...what a racket! Don't get caught in this little trap.

Loans I'm not going to give a lot of detail on this one because I think it is a bad idea and only should be used to save you from bankruptcy. There are too many big negatives other wise to consider this option for debt consolidation. You loss your tax benefits and may have to pay a penalty if this don't go smoothly for you. Not to mention the big kicker that if you are borrowing money from yourself that means your money is not working for you but against you. Not only that if you lose your job or quit you most likely have to pay off the loan immediately.

Debt Consolidation Loans Even though they may seem to be the best choice or even the most logical, it still may not be your best bet. A debt consolidation loan is an unsecured personal loan, and they can be difficult to get if you already have a lot of debt. The bank doesn't like to give you a loan if you monthly payment on your debt not counting your mortgage is more than 15%-25%, depending on your credit, of your gross monthly income (before taxes). The bank feels like you are just going to go and charge back up your balances, which happens all too often.

These are definitely not the best interest rates compared to the other items we discussed so far. However, if you can get a debt consolidation loan with an interest rate better than what you have right now it may be beneficial for you to get one. Consider a Debt Consolidation Loan if: You are willing to close your credit card accounts so you don't end up in the same trap everyone else does and dig a deeper hole of debt. The interest rate you will be paying is lower than what you are paying right now on any debts that you would consolidate.

Don't use a Debt Consolidation Loan if: the most obvious reason is if the interest rate is way too high. The term of the loan has been extended to 10 or 15 years. It will show you a really cheap payment but wait until you add up all the money you will be paying back you won't consider it a good deal then. Counseling Agencies As the ads on late night TV and cable claim to be able to consolidate your debt i.e. "bills", into one small monthly payment "no matter what your credit history".

Counseling agencies go to the lender and negotiate a lower interest and/or fee. After that you end up making one monthly payment to the counseling agency, Which then pays your creditors. Their fee is lumped into the monthly payment. A lot of times you could have done much better of for yourself if you would have dealt with the creditors personally. This is not really a debt consolidation loan since you don't really refinance anything, it more like debt restructuring. If you can stick with the program you can be out of debt in 3-5 years.

Quite honestly if you are already behind on your bills and haven't been able to put a dent in them, a counseling agency debt consolidation program is not going to make your credit much worse than it already is. It will make your score drop a bit, but when you look at the benefit of being debt free a few years down the line it's a lot better alternative to declaring bankruptcy. Consider debt consolidation with a counseling agency if: You are falling way behind on your bills and there is not another alternative.

Most of your debt is not a secured loan. In other words a car loan, home loan, or a student loan. Since there is collateral involved the counseling agency has a harder time renegotiating the terms. Don't do debt consolidation with a counseling agency if: You know yourself better than anyone else if you can't stick to a little program for a week or a few months by all means don't try and do this program that is going to take a few years to complete. You haven't done you due diligence and thoroughly checked out the company.

Management Plan. -pressure you to make "voluntary contributions," another name for fees. -won't send you free information about the services they provide without requiring you to provide personal financial information, such as credit card account numbers, and balances. -try to enroll you in a Debt Managment Program without spending time reviewing your financial situation. -offer to enroll you in a Debt Managment Program without teaching you budgeting and money management skills. -demand that you make payments into a Debt Managment Program before your creditors have accepted you into the program.

Alternatives to Debt Consolidation Now it's time to start to use that space between your ears, your brain. Just because none of these options work for you doesn't mean that you should give up! You have made it this far. Borrow against the cash value of your life insurance policy. If you've built up a cash value in your policy, you should be able to tap it at a low rate. Best of all, it doesn't have to be repaid.

You may want to buy a supplemental term policy.) Make it easy for yourself call all your credit card companies and get them to change the due dates that are more convenient for you so they fall all on the same day right around payday. This way you sit down once or twice a month to do your bills instead of 10 different days.

    The Wrap Up of 2004

This is it. The end of another year. For some of you the next few days will either be frantic or quiet, depending on the business you are in.I hope those of you who are quiet are spending your time wisely planning what you want to achieve for 2005.For the rest of you no doubt, January will be the time when future plans will be made.Regardless of when you do it, you need to plan where you want to be personally and professionally this time next year. If there is no planning or goalsetting, you will continue to meander along and take what life dishes out to you. You'll be reactive, not proactive.

Do a Personal StocktakeWrite down the answers to these questions:What have I achieved this year? What do I want to achieve by the end of 2005? What skills, courses, people do I need to help me reach my goals for next year? List the specific ACTIONS you need to take. Plan in your diary when you will carry them out. This last step is very important. You can have all the great intentions in the world yet if you don't commit specifically when you are going to act, your goals may end up being wishful thinking and never eventuate.

By the way, these same principles apply to your personal life. Sit down with your partner, family or whoever you feel should be involved in this process and set your goals together.Nothing Changes if Nothing ChangesChristmas is an interesting time of year. Some are shining in their successes and can't wait to tackle the coming year after a well-earned holiday. For others it can be sad, reflecting on the year gone by all too fast.

They are burnt out by working too much, keeping too busy and not looking after themselves.Goals were set, only to be broken because life got in the way. It was much easier floating along with the crowd.Unfortunately if you float along, you could end up anywhere. And more often than not, the crowd is heading in the wrong direction. The Final WordAccording to Henry Ford the hardest work known to 'man' is'thinking'.

Christmas break knowing that you have succeeded in achieving the goals you set for yourselfyou have taken control of your life instead of life taking control of you.The sense of satisfaction attained by setting goals and achieving them will boost your confidence and motivate you to strive even harder.

Senior Housing Services, Inc. Settles Litigation Related to San Antonio Seniors Community

Senior Housing Services, Inc. (SHS), a nonprofit corporation, along with the other parties named, has settled a private lawsuit and resolved a Federal investigation into alleged Fair Housing Law violations related to Newforest Estates, an independent living community in San Antonio.

SHS, which acquired Newforest Estates in June 2003, was not involved in whatever policies and practices may have existed under the previous ownership and management, according to Alan Gooding, attorney for SHS. "We have taken the position throughout this lawsuit that we do things the right way and that despite what may have gone on at Newforest before we came on board, the current ownership and management treat the residents here with the utmost care and respect," said Bill Layer, regional vice president of SHS. In the fair housing civil lawsuit, Casaregola, et al. v.

Retirement Services of America, Inc, d/b/a CRSA Holdings, Inc., Pacific Life Insurance Co., Senior Housing Services, Inc., the plaintiffs contended that the previous management evicted residents who did not fit in with the company's new marketing strategy aimed at "active seniors" and "independent living." The suit contended the previous owners discriminated on the basis of disability in the rental of retirement housing. The plaintiffs sought declaratory and injunctive relief as well as unspecified monetary damages. The suit was filed in the U.S.

Court for the Western District of Texas in San Antonio. SHS purchased the facility, then known as the Summit at Newforest, a year after the alleged evictions occurred. The parties and the government have agreed to have the civil lawsuit dismissed and the government investigation concluded as to the current and former owners and management of the community. SHS owns the community, now called Newforest Estates, and has a management agreement with Certus, LLC, a senior-living management firm.

'Your Instinct is Your Life-blood,' says author.

Fourteen thousand civilised people died when the tsunami hit Andaman Islands five percent of the population meanwhile a cannibal tribe, inhabiting the same island, hardly lost a life. And do you know what saved them the earliest early-warning system known to man. When the Jarawa tribe saw jungle creatures performing a speedy mass exodus they decided they should peg it too. Meanwhile civilised men may have noticed the lack of birds singing in the trees or their dog straining the leash and did nothing. Clearly something separates tribal man from civilised man.

The fact that they act while we suppress clearly shows that life and death comes down not just to instinct, but the way we use it, if we use it at all.You and I could be as instinctive as any tribesman if we practiced it, but everyday, in our daily actions, we choose to ignore our instincts. We go to a work-place that depresses us; do work we hate and take pills to dull the pain and make it more bearable.

All thisjust to survive. And that is exactly what it is for most of us survival hanging in there, doing the job that kills our soul, taking on contracts that turn our gut because we believe there is no other option, doing food that causes our major organs to breakdown, living at a financial level just above subsistence level, with just about enough money left at the end of the week to buy a tin of food for that dog. Will you wake up, please? Will you see how your instincts are telling you about your work? Will you find work that gives you life instead of sapping every living cell out of you?

Will you take the hint that there is something you can do to save your marriage or relationship?Instinct is only about feeling something and acting. It could save your career, your finances, your relationship and you life.Mike Edwards is a soldier who ignored all instinct. His life is in a mess and he has been sent to find and free an environmentalist, held on a group of islands in the Bay of Bengal on a group of islands where the cannibal tribe, the Jarawa, exist. Now Edwards must face the demons of his own mind and the demons on his mission.

    New Year

Now that the new year is here, many of us are struggling to hold onto our usual new year's resolutions. Have you noticed that most of the time resolutions add to your "to-do" list rather than simplifying your life? Why not making a resolution to simplify your life instead? Do you often feel overwhelmed with things to do, places to be? You enjoy being productive but feel frantic during the day? You are organized and live by your to-do list and yet this chore list seems to get longer rather than shorter?

Simplifying one's life means just that, letting go of certain habits, conventions, or actions that don't serve you in creating more meaning in your life, and then using that energy to create connections, peace and a sense of gratitude. We all want to be of service, be professional, get things done, be responsible and reliable, be the best we can be but we often forget ourselves on the way. No wonder we end up feeling so overwhelmed.

These changes will allow you to find more fulfillment and joy in your everyday activities. Peace and serenity are attainable when you re-arrange your life for more balance. The most common complaint I hear in my coaching practice is from the "Super mom." (Now, this example also applies to you men, so read on.) The "super mom" has a demanding career but she also volunteers at school, bakes cookies for her children's class, takes care of the house, chauffeurs the kids around and listens to her partner's concerns late at night. All of these responsibilities may be important to her.

There is only one solution: Simplify! To experience more joy, we need to let go of certain activities, to create a space that we can fill with more meaning. All our obligations and assignments are serving some purpose. Yet, we need to have the courage to say "No" so that we can slow down and make time for ourselves. We also need to get to know ourselves. Often we have not taken time for reflection on what gives us true fulfillment. Once we know what we really want, we need to put a realistic plan in place.

We need to create a list of those activities we will courageously say "No" to, scheduling blocks of time for whatever holds meaning for us and then safeguarding them. We also need someone to hold us accountable during these times of creating new habits and lifestyle changes. Tell a friend, a coach, your partner or even your boss which changes you will accomplish. Lastly, we need to consistently take action on our new plans until the new rhythm of life becomes a habit. So, what can you say "No" to today so that your life will be simpler and more meaningful?

Where can you create a space that you then thoughtfully fill with something that holds deep meaning to you? If you chose one action that would allow you to create some time for peace, reflection and connection, what would it be? How frequently do you need this special time? How can you safeguard it? And who should you tell about your plans? Who can be your support? Today's the day to make a commitment to yourself. Get out your calendar and block off that special time for the coming month. And keep saying "No thank you" to new obligations that would jeopardize your time for you.

Life Settlement :Towards A Free Market for Life Insurance

The Life Settlement market is all about providing due access to needed cash from existing life insurance. This so-called free market referred to as the life insurance industry's secondary market is based on a central premise, namely that the value of life insurance is best determined by independent market forces and has been validated in recent years by its rapid growth. It is also amazing to see the value creation and opportunities that this market presents. What it a life settlement and why may it be an attractive financial alternative to policy holders?

Maximizing the profitable offering price for your life insurance policy in what is commonly referred to the secondary market for life insurance. Quite innovative, albeit counter-intuitive, advocating looking at things from a totally different perspective and finding new value in life insuranceLife insurance provides financial solutions to meet various needs of businesses and families. Over time, however it also needs to be dynamic and change with the holders and the/their demands.

Until just several years ago, individuals in the situations laid out about above were facing a monopoly, a market situation in which a seller can only sell to one buyer. Imagine if a homeowner, after living in the home for many years, was told that instead of being permitted to sell the home to any willing buyer, he or she could only sell it back to the original builder at the price determined by the builder. Clearly, no one would tolerate such a situation for homeowners, but it has existed for life insurance policy owners.

The advent of a secondary market has lessened the monopoly power of life insurers and created a free market for policy owners to create value from and using their insurance. Before the advent of the secondary market, life insurance policies could not readily be sold, and it would have made little sense to speak of a policy's fair market value. By its very existence, this new and growing secondary market for life insurance bestows on every policy a fair market value like the owner's other financial assets. A life settlement can now be treated like any other financial vehicle.
